Kenneth Hiller began his legal career in 1984 working for a small law firm in East Aurora, New York. At that firm, and at others he
worked at thereafter, he had the opportunity to represent a wide variety of clients, from corporations, to low-income individuals. Over time, Ken found that the legal system seemed to favor rich
people over poor people. "It seemed like whoever had the more expensive lawyer would get the better result in court."
In 1988, Ken was working at a real estate firm in Rochester. "At that time I had the opportunity to work for a large corporation. But
I decided I wanted to help people." So, in 1988, Ken began working at a large Buffalo law firm that handled Bankruptcy and Social Security Disability cases. During that time, Ken handled
thousands of cases, and became recognized as one of the leading local lawyers in both of those fields.
But Ken still was not satisfied. "I found that at a large firm I didn't
have enough contact with my clients, and it was almost impossible for them to contact me. If they called, they were always forwarded to a paralegal." Thus, in 1999, Ken started his
own firm. He has already handled over 1000 cases in that short time. "I think one of the most satisfying things that has happened is that people who I represented 10 years ago track me down
when they need a lawyer again. And now, when they have a concern about their case, they can talk to me personally."
Mr. Hiller obtained his law degree from the State University of
New York at Buffalo in 1983, after receiving his undergraduate degree from Kent State University in 1980. He is a member of the
National Organization of Social Security Claimant's Representatives (NOSSCR) and the National Association of Consumer Bankruptcy Attorneys (NACBA). Mr. Hiller has handled literally thousands
of Social Security Disability and Bankruptcy cases, including over 100 that have gone to the Federal
District Court and a handful that have gone to the Court of Appeals (the Court just below the Supreme
Court of the United States). Ken says that he is "still waiting for that case that will make it to the Supreme Court."
With respect to his philosophy as a lawyer, Ken says "Once I accept a case, I will take it as far as
necessary to win it, as long it makes sense for my client. When I lose a case, I take it personally, and my first instinct is to figure out how I can challenge the decision."
Mr. Hiller wins over 90% of his Social Security cases. When he loses before an Administrative Law
Judge, he usually appeals the decision. "It really makes me angry when I have a client bring in an
obviously flawed Social Security decision and they tell me their lawyer decided not to appeal their
case. I don't believe in abandoning my clients like that. And I think other lawyers should be up front
with their clients and tell them if they are not going to be willing to appeal their case if it is unsuccessful before the Administrative Law Judge."
Ken's experience has resulted in several well-known Court decisions in both the Social Security and
Bankruptcy area being decided by the Courts (see links below to see significant cases handled by Mr. Hiller). He has also given lectures to the public and to lawyers about these areas of law.
Mr. Hiller also handles Long Term Disability claims, Consumer matters, and Personal Injury cases. Contact Kenneth Hiller at khiller@kennethhiller.com or (716) 564-3288
