One of the things we get asked a lot is if a decision from an administrative law judge or an ALJ can be overturned. After the decision, there are several steps of appeal.

I personally work in the Federal Court department. That is the second stage after the ALJ’s decision; what we do is file a complaint in the Federal Court trying to overturn the ALJ’s decision. What happens then?

The federal court can issue a decision affirming that the ALJ was right; that’s the worst case. What we’re trying to do is get a decision to overturn his decision. That means we can remand it and go back to a new ALJ for a hearing. That’s what we’re trying to do.

In a few cases, sometimes the ALJ’s decision will be completely reversed, and they will grant your benefits. That happens least often, but it is something that can happen.
