Denied Social Security Disability Claims?

Taking Your Case Through the Appeals Process

Having your Social Security disability (SSD) or SSI application denied does not necessarily mean you are not entitled to benefits. Statistically, almost two-thirds of applications are denied. Yet most of these denials are ultimately reversed when they go through the appeals process.

At The Law Offices of Kenneth Hiller, PLLC, we represent clients whose disability benefits claims have been denied. Contact us for a free consultation with a knowledgeable Social Security lawyer.

Requesting a Hearing With the Social Security Administration

If your initial Social Security disability claim is denied, the next step is to request a hearing before an administrative law judge. Statistically, this hearing is your best chance to obtain the benefits you’ve previously been denied, so it is very important to be prepared.

Our attorneys will meticulously go over every aspect of your case in preparation for your hearing. Some lawyers don’t meet with their clients until the day of the hearing. Not at our firm. We will meet with you prior to your hearing to prepare you for it. When the time comes, you will be ready to testify, and we will be ready to argue for the benefits you deserve.

Hearings are held in Buffalo, Rochester, Syracuse, Olean, Corning and other locations throughout New York. On average, it takes 15 to 18 months to get a hearing, but under certain conditions, we can get some hearings expedited.

If the hearing is not successful, we can pursue your case at the Appeals Council and, if necessary, file an appeal in federal district court. At our firm, we aggressively pursue appeals where we feel the SSA wrongly denied our clients claim.

Identifying and Correcting the Reasons for Denial

If your initial claim for disability benefits has been denied, our attorneys will determine why and then pursue the documentation we need to pursue a reversal of that decision. Among other things, we will work with your doctor to get any medical records you may be missing.

We are highly experienced with the appeals process for denied claims and have helped thousands of clients successfully obtain benefits at the hearing stage. Contact us today to discuss how we can help you pursue a positive outcome.
